Introduction
Welcome to Travo-Africa ("we," "our," or "us"). These Terms and Conditions ("Terms") govern your access to and use of the Travo-Africa mobile application ("App") and website located at www.travo-africa.com ("Website"), including all features, content, and services available through either platform (collectively, the "Platform").
By downloading, installing, or using the App, or by accessing or browsing the Website, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must immediately uninstall the App and discontinue use of the Website.
Definitions
Access to the App & Website
The Travo-Africa App is available for download on iOS (Apple App Store) and Android (Google Play Store). You are responsible for ensuring your device meets the minimum technical requirements for the App to function properly.
The Website is accessible via any standard web browser. Travo-Africa does not guarantee uninterrupted or error-free access to the Website at all times.
Travo-Africa may release updates to the App from time to time. Some updates may be required for continued use of the App. We recommend keeping the App updated to the latest version for the best experience and security.
Your download and use of the App is also subject to the terms of the relevant app store (Apple App Store or Google Play Store). In the event of a conflict between those terms and these Terms, these Terms shall prevail to the extent permitted.
We reserve the right to modify, suspend, or discontinue the App or Website (or any features thereof) at any time without prior notice. We shall not be liable to you or any third party for any such modification, suspension, or discontinuation.
Eligibility
To use Travo-Africa, you must:
- Be at least 18 years of age, or have parental/guardian consent;
- Possess the legal capacity to enter into a binding agreement;
- Not be barred from using the Platform under any applicable law.
By registering or making a booking, you represent and warrant that you meet these eligibility requirements.
Account Registration
You may be required to create an account to access certain features of the Platform.
You agree to provide accurate, current, and complete information during registration and to update it as necessary.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
Travo-Africa reserves the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.
Bookings & Payments
A booking is confirmed only upon receipt of a confirmation email or notification from Travo-Africa. We reserve the right to cancel unconfirmed bookings.
All prices displayed on the Platform are in the applicable currency as stated and are subject to change without prior notice until a booking is confirmed.
Payment must be made in full at the time of booking unless a payment plan is explicitly offered. We accept major credit/debit cards, mobile money, and other approved payment methods.
Prices may be subject to applicable taxes, service charges, and government levies, which will be disclosed prior to checkout.
Some bookings may be processed directly by Service Providers. Travo-Africa is not responsible for errors or delays caused by third-party payment processors.
Cancellations & Refunds
Cancellation policies vary by Service Provider and booking type. The applicable cancellation policy will be displayed at the time of booking. Users should review these policies carefully before confirming a booking.
If a Service Provider cancels a confirmed booking, Travo-Africa will endeavour to offer a suitable alternative or a full refund, as applicable.
Refunds, where applicable, will be processed within 7-14 business days using the original payment method. Processing times may vary depending on your financial institution.
7.4 Non-Refundable Bookings
Certain bookings are explicitly marked as non-refundable. By confirming such bookings, you acknowledge and accept this condition.
Travel Documents & Compliance
8.1 You are solely responsible for ensuring that you hold valid travel documents, including passports, visas, health certificates, and any other documents required by your destination or transit countries.
8.2 Travo-Africa does not guarantee entry into any country and shall not be liable for any losses arising from your failure to hold the required documentation.
8.3 You must comply with all applicable laws, regulations, and local customs at your travel destination.
Health & Safety
9.1 You acknowledge that travel, particularly within Africa, may involve inherent risks including, but not limited to, wildlife encounters, remote locations, and varying health conditions.
9.2 It is your responsibility to consult a qualified medical professional regarding vaccinations, health precautions, and travel insurance before departure.
9.3 Travel Insurance
Travo-Africa strongly recommends that all users obtain comprehensive travel insurance covering medical emergencies, trip cancellations, and loss of personal belongings.
Intellectual Property
10.1 All content on the Platform, including logos, trademarks, text, photographs, graphics, and software, is the intellectual property of Travo-Africa or its licensors.
10.2 You may not copy, reproduce, distribute, modify, or create derivative works from any Platform content without our prior written consent.
10.3 User-generated content (such as reviews or photos) submitted to the Platform grants Travo-Africa a non-exclusive, royalty-free, worldwide licence to use, display, and promote such content.
User Conduct
You agree not to:
- Use the Platform for any unlawful or fraudulent purpose;
- Post false, misleading, or defamatory content;
- Attempt to gain unauthorised access to our systems or data;
- Engage in any activity that disrupts or interferes with the Platform;
- Use automated tools, bots, or scrapers to access Platform content without authorisation;
- Harass, threaten, or harm other users or Service Providers.
Limitation of Liability
12.1 Travo-Africa acts as an intermediary between users and Service Providers and is not directly responsible for the delivery of travel services.
12.2 To the fullest extent permitted by law, Travo-Africa shall not be liable for any indirect, incidental, consequential, or punitive damages arising from:
- Service Provider failures, cancellations, or changes;
- Loss or damage to personal belongings;
- Travel delays, accidents, or personal injury;
- Acts of God, natural disasters, or force majeure events;
- Political instability, civil unrest, or government actions.
12.3 Our total liability to you in connection with any claim shall not exceed the total amount paid by you for the specific booking to which the claim relates.
Indemnification
You agree to indemnify and hold harmless Travo-Africa, its directors, employees, partners, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising out of your use of the Platform, breach of these Terms, or violation of any applicable law.
Privacy Policy
Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to the collection, use, and sharing of your information as described in our Privacy Policy.
Dispute Resolution
In the event of any dispute, both parties agree to first attempt to resolve the matter amicably through good-faith negotiation within 30 days of written notice.
If negotiation fails, disputes shall be referred to binding arbitration in accordance with the rules of a mutually agreed arbitration body.
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Travo-Africa is registered, without regard to conflict of law principles.
Modifications to Terms
Travo-Africa reserves the right to update or modify these Terms at any time. Changes will be effective upon posting to the Platform. Continued use of the Platform following any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
Termination
Travo-Africa may, at its sole discretion, suspend or terminate your access to the Platform at any time, with or without cause, and without prior notice. Provisions of these Terms that by their nature should survive termination shall continue to apply.
Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
Entire Agreement
These Terms, together with the Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Travo-Africa with respect to your use of the Platform and supersede all prior agreements.
